The problem I see is that there is no way to prove the AI was used for the codebase. So unless someone from the team leaks, yeah, you can make an unfair competition.

if your competition can lie, so can you

but if you spend so long making a game, you likely would not want to risk it being removed for breaking the rules

Clues are often left and can be seen during decompilation attempts, data-mining, etc.
