Theoretically a court can actually order the people that installed and deployed that to install something else instead.

If you've subverted the organization itself, it doesn't matter what the organization claims to have as hardware and software.

Anyways, if you genuinely want to know more, go read about the Snowden Revelations, 5-eyes (previously 4-eyes), FISA courts and so on.
