The state is not above class struggle, or above the ruling class, but is representative of any given society's ruling class. To get rid of the state, you have to erase its basis, and thay requires collectivizing production and distribution. As ownership is collectivized, class is eroded, and the elements of the state that enforce class distinctions and uphold the ruling class such as an oppressive police force fade away and wither.
