I agree, but I would argue that if push came to shove a judge would rule the term unfair.

In the article it gives examples of an $80K/y nurse barred from working in healthcare in Australia or New Zealand or a $75k/y graduate engineer barred from working in Victoria for 12 months. No way a judge would call those a fair employment clause.
